Dazu geh\u00f6ren auch strenge Vorschriften \u00fcber die vorvertraglichen und\nvertraglichen Informationen, die ein Gewerbetreibender Verbrauchern zur Verf\u00fcgung\nstellen muss, das Recht des Verbrauchers, einen Vertrag binnen 14 Tagen zu widerrufen,\nund das w\u00e4hrend der Widerrufsfrist geltende Anzahlungsverbot.<\/span><\/p>\n<p><span style=\"color: #000000;\">Der Widerruf muss innerhalb von 14 Tagen nach Vertragsunterzeichnung beim Unterkunftsanbieter eingehen. Der Versand sollte per eMail mit Versand- und Lesebest\u00e4tigung erfolgen, um nachweisen zu k\u00f6nnen, dass der Widerruf auch tats\u00e4chlich verschickt wurde.<\/span><\/p>\n<p><span style=\"color: #000000;\">F\u00fcr alle Arten von Vertr\u00e4gen in diesem Bereich verbietet das Gesetz vor dem Ende der R\u00fccktrittsfrist Anzahlungen, Sicherheitsleistungen, Sperrbetr\u00e4ge auf Konten oder sonstige Gegenleistungen des Verbrauchers.<\/span><\/p>\n<p><span style=\"color: #000000;\">In der Timesharing-Richtlinie wird eine Reihe von Verbraucherrechten mit Blick auf derartige\nVertr\u00e4ge definiert. Die vorvertraglichen Informationen betreffen beispielsweise die Vertragsdauer, den Preis und die zus\u00e4tzlichen Kosten.Mit Blick auf die sprachlichen Anforderungen sieht die Richtlinie vor, dass Verbraucher\nentscheiden k\u00f6nnen, ob ihnen die vorvertraglichen Informationen und der Vertrag selbst in\nder Sprache des Mitgliedstaats, in dem sie ans\u00e4ssig oder dessen Staatsangeh\u00f6rige sie sind,\nbereitgestellt werden.<\/span><\/p>\n<p><span style=\"color: #000000;\">Die Anh\u00e4nge zur Richtlinie enthalten eine Reihe von Formbl\u00e4ttern f\u00fcr die\nBereitstellung vollst\u00e4ndig harmonisierter vorvertraglicher Informationen und ein\nStandardformblatt zur Erleichterung der Wahrnehmung des Widerrufsrechts durch den\nVerbraucher innerhalb einer Frist von 14 Tagen. Nach Ma\u00dfgabe der Richtlinie sind die\nInformationen kostenfrei und ohne \u00c4nderungen auf einem dauerhaften Datentr\u00e4ger\nbereitzustellen, der archiviert werden kann.<\/span><\/p>\n<h5><span style=\"color: #00004d;\"><u>Die wichtigsten Punkte des Urteils sind <\/u><\/span><\/h5>\n<ol>\n<li><span style=\"color: #00004d;\">Das so genannte Widerrufsrecht gilt in der Regel 14 Tage nach Abschluss eines Vertrages<\/span><\/li>\n<li><span style=\"color: #00004d;\">Fehlende Information \u00fcber das Recht auf R\u00fccktritt vom Vertrag<\/span><\/li>\n<li><span style=\"color: #00004d;\">Der Verk\u00e4ufer darf niemals einen Vorschuss oder eine Anzahlung verlangen, solange die Widerrufsfrist l\u00e4uft.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Die Vertr\u00e4ge oder Urkunden m\u00fcssen schriftlich abgefasst sein.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Fehlende Bereitstellung von relevanten und wichtigen Informationen bez\u00fcglich der\nImmobilie und\/ oder des Verk\u00e4ufers<\/span><\/li>\n<li><span style=\"color: #00004d;\">Sie m\u00fcssen alle Einzelheiten schriftlich in Ihrer eigenen Sprache erhalten<\/span><\/li>\n<li><span style=\"color: #00004d;\">Wenn Sie im Rahmen eines Wiederverkaufsvertrags einen Vermittler eingeschaltet haben, der Ihnen beim Verkauf Ihres Ferienwohnrechts oder Ihrer Ferienclub-Mitgliedschaft helfen soll, so darf dieser keine Zahlung von Ihnen fordern, bis der Verkauf abgeschlossen ist oder der Wiederverkaufsvertrag anderweitig beendet wurde.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dass die Vertragsdauer nicht l\u00e4nger als 50 Jahre betragen sollte.<\/span><\/li>\n<\/ol>\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>Das Urteil des Obersten Gerichtshofs hat best\u00e4tigt, dass alle Vertr\u00e4ge eine 14-t\u00e4gige Widerrufsfrist f\u00fcr den Kauf von Produkten haben sollten, die in ganz Europa g\u00fcltig ist.
