Le 15 janvier 2015, un arr\u00eat de la Cour supr\u00eame espagnole est entr\u00e9 en vigueur \u00e0 la suite de la r\u00e9glementation susmentionn\u00e9e.<\/p>\n

La Cour a donn\u00e9 raison \u00e0 une ressortissante norv\u00e9gienne qui soutenait que la clause de \"perp\u00e9tuit\u00e9\" de son contrat de multipropri\u00e9t\u00e9 avec Anfi Resorts \u00e9tait ill\u00e9gale au regard du droit communautaire.<\/p>\n

Dans cette affaire in\u00e9dite, contre les g\u00e9ants de la multipropri\u00e9t\u00e9 \u00e0 Gran Canaria, le tribunal a jug\u00e9 qu'une clause de \"perp\u00e9tuit\u00e9\" viole la loi espagnole, en ce sens qu'un contrat de multipropri\u00e9t\u00e9 sign\u00e9 apr\u00e8s le 5 janvier 1999 ne peut d\u00e9passer 50 ans.<\/p>\n

En cons\u00e9quence, pour le plaignant, l'ensemble du contrat est devenu invalide et le tribunal a ordonn\u00e9 \u00e0 Anfi de rembourser tous les paiements ainsi que tous les int\u00e9r\u00eats encourus, tous les frais juridiques et le double du montant que la cliente avait vers\u00e9 pour son acompte.<\/p>\n

Cela a eu par la suite un impact \u00e9norme sur les propri\u00e9taires de temps partag\u00e9 qui ont sign\u00e9 leur contrat apr\u00e8s le 5 janvier 1999 et a ouvert davantage de possibilit\u00e9s pour les propri\u00e9taires qui esp\u00e9raient \u00e9chapper \u00e0 leur contrat.<\/p>","protected":false},"excerpt":{"rendered":"
