{"id":148,"date":"2021-03-01T14:46:45","date_gmt":"2021-03-01T14:46:45","guid":{"rendered":"https:\/\/legalexits.com\/?p=148"},"modified":"2021-10-01T15:48:50","modified_gmt":"2021-10-01T15:48:50","slug":"first-timeshare-ruling-from-the-spanish-supreme-court-perpetuity","status":"publish","type":"post","link":"https:\/\/legalexits.com\/it\/first-timeshare-ruling-from-the-spanish-supreme-court-perpetuity\/","title":{"rendered":"Prima sentenza della Corte Suprema spagnola con riferimento alla \"Perpetuit\u00e0"},"content":{"rendered":"<p>Il 15 gennaio 2015 \u00e8 entrata in vigore una sentenza della Corte Suprema spagnola come risultato delle suddette norme.<\/p>\n<p class=\"translation-block\">La Corte ha dato ragione a una cittadina norvegese che sosteneva la illegalit\u00e0 secondo il diritto comunitario della clausola \"in perpetuit\u00e0\" stipulata nel suo contratto di multipropriet\u00e0 con Anfi Resorts.<\/p>\n<p class=\"translation-block\">In questo caso rivoluzionario, a danno dei giganti della multipropriet\u00e0 con sede a Gran Canaria, il tribunale ha stabilito che una clausola di \"<em>perpetuit\u00e0<\/em>\" viola la legge spagnola, in quanto un contratto di multipropriet\u00e0 firmato dopo il 5 gennaio 1999 non pu\u00f2 superare i 50 anni.<\/p>\n<p>Di conseguenza, per la ricorrente, l'intero contratto \u00e8 stato dichiarato invalido e il tribunale ha ordinato ad Anfi di rimborsare tutti i pagamenti cos\u00ec come la totalit\u00e0 degli interessi sostenuti, le spese legali e il doppio della somma che la cliente aveva pagato a titolo di caparra.<\/p>\n<p>Questo caso ha avuto un impatto enorme sui proprietari di multipropriet\u00e0 che hanno firmato il loro contratto dopo il 5 gennaio 1999 e ha aperto grandi speranze per quelli che auspicavano liberarsi dal loro contratto.<\/p>","protected":false},"excerpt":{"rendered":"<p>In data 15 gennaio 2015 \u00e8 entrata in vigore una sentenza della Suprema Corte spagnola a seguito delle citate normative.
