{"id":435,"date":"2021-03-03T13:46:49","date_gmt":"2021-03-03T13:46:49","guid":{"rendered":"https:\/\/legalexits.com\/?p=435"},"modified":"2021-10-01T15:48:38","modified_gmt":"2021-10-01T15:48:38","slug":"ruling-from-the-spanish-supreme-court-regarding-cooling-off-period-and-the-provision-of-information","status":"publish","type":"post","link":"https:\/\/legalexits.com\/it\/ruling-from-the-spanish-supreme-court-regarding-cooling-off-period-and-the-provision-of-information\/","title":{"rendered":"Sentenza della Corte Suprema spagnola sul periodo di riflessione e la fornitura di dati"},"content":{"rendered":"<p><span style=\"color: #000000;\">La sentenza della Corte Suprema ha avallato che tutti i contratti avrebbero dovuto avere un periodo di riflessione di 14 giorni, per l'acquisto di prodotti validi in tutta Europa.<\/span><\/p>\n<p><span style=\"color: #000000;\">Questo periodo di riflessione di 14 giorni avrebbe permesso agli aquirenti di considerare il loro acquisto , fare domande e recedere dal contratto senza penalit\u00e0 nel caso in cui cambiassero idea.<\/span><\/p>\n<p><span style=\"color: #000000;\">Inoltre per i venditori stipula il divieto di esigere dall'acquirente somme di denaro a qualsiasi titolo fino alla scadenza del termine concesso per l'esercizio del diritto di recesso.<\/span><\/p>\n<p><span style=\"color: #000000;\">La direttiva stabilisce anche che i venditori di qualsiasi multipropriet\u00e0 sono obbligati a fornire informazioni dettagliate agli acquirenti in tempo reale e prima che l'acquirente si comprometta a stipulare un contratto.<\/span><\/p>\n<p><span style=\"color: #000000;\">Le informazioni devono includere il prezzo da pagare, una descrizione dettagliata dell'acquisto compresa la posizione e il numero della multipropriet\u00e0, i dettagli dell'appartamento \/ unit\u00e0 \/ settimana (i) e il periodo esatto e la durata del soggiorno a cui l'acquirente ha diritto in base al contratto. Queste informazioni devono essere fornite inoltre nella lingua dell'acquirente.<\/span><\/p>\n<p><span style=\"color: #000000;\">Il venditore in particolare \u00e8 tenuto a rendere informazioni complete circa il diritto di recesso dal contratto con l'indicazione degli elementi identificativi della persona alla quale deve essere comunicato il recesso stesso, precisando le modalit\u00e0 della comunicazione e l'importo complessivo delle spese, specificando quelle che l'acquirente in caso di recesso \u00e8 tenuto a rimborsare;<\/span><\/p>\n<h5><span style=\"color: #00004d;\"><u>In sintesi, i principali punti di interesse della sentenza sono <\/u><\/span><\/h5>\n<ol>\n<li><span style=\"color: #00004d;\">L'obbligo di applicare il periodo di recesso di 14 giorni dalla data d'aquisto.<\/span><\/li>\n<li><span style=\"color: #00004d;\">L'aquirente deve essere informato sul periodo di recessso<\/span><\/li>\n<li><span style=\"color: #00004d;\">Il divieto di esigere dall'acquirente somme di denaro a qualsiasi titolo fino alla scadenza del termine concesso per l'esercizio del diritto di recesso.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Il contratto deve essere per iscritto<\/span><\/li>\n<li><span style=\"color: #00004d;\">Prima di firmare un contratto, alcuni elementi informativi devono essere chiariti al cliente come il diritto oggetto del contratto, con specificazione della natura e delle condizioni di esercizio di tale diritto nello Stato in cui \u00e8 situato l'immobile; se tali ultime condizioni sono soddisfatte o, in caso contrario, quali occorre soddisfare.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Il contratto deve essere redatto nella lingua dell'aquirente<\/span><\/li>\n<li><span style=\"color: #00004d;\">In caso di disdetta dell'accordo da parte del cliente, per esempio durante il periodo di riflessione, anche tutti gli altri contratti di finanziamento correlati vengono annullati.<\/span><\/li>\n<li><span style=\"color: #00004d;\">La durata del contratto non pu\u00f2 superare i 50 anni.<\/span><\/li>\n<\/ol>\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>La sentenza della Corte Suprema ha approvato che tutti i contratti avrebbero dovuto avere un periodo di riflessione di 14 giorni, per l&#039;acquisto di prodotti validi in tutta Europa.
