{"id":435,"date":"2021-03-03T13:46:49","date_gmt":"2021-03-03T13:46:49","guid":{"rendered":"https:\/\/legalexits.com\/?p=435"},"modified":"2021-10-01T15:48:38","modified_gmt":"2021-10-01T15:48:38","slug":"ruling-from-the-spanish-supreme-court-regarding-cooling-off-period-and-the-provision-of-information","status":"publish","type":"post","link":"https:\/\/legalexits.com\/nl\/ruling-from-the-spanish-supreme-court-regarding-cooling-off-period-and-the-provision-of-information\/","title":{"rendered":"Uitspraak van het Spaanse Hooggerechtshof met betrekking tot de afkoelingsperiode en de informatieverstrekking."},"content":{"rendered":"<p><span style=\"color: #000000;\">De uitspraak van het Hooggerechtshof heeft voorgeschreven dat alle contracten een afkoelingsperiode van 14 dagen hadden moeten krijgen voor de aankoop van producten en dit is geldig in heel Europa.<\/span><\/p>\n<p><span style=\"color: #000000;\">Gedurende deze periode van 14 dagen zouden de consumenten in staat zijn gesteld om hun aankoop te overwegen en vragen te stellen over de producten die ze hebben geselecteerd en zich desgewenst terug te trekken uit de overeenkomst, zonder sancties.<\/span><\/p>\n<p><span style=\"color: #000000;\">Bovendien waren de verkopers verboden om enige vorm van aanbetaling te vragen.<\/span><\/p>\n<p><span style=\"color: #000000;\">De richtlijn bepaalt ook dat er bij alle Timeshare-producten die door handelaren worden verkocht, voor ondertekening van het contract, gedetailleerde informatie moet verstrekt worden aan de klant.<\/span><\/p>\n<p><span style=\"color: #000000;\">De informatie moet de te betalen prijs bevatten, een gedetailleerde beschrijving van de aankoop inclusief de Timeshare-locatie en het aantal, details van het appartement \/ de unit \/ week (en) en de exacte periode en duur van het verblijf waarop de koper volgens het contract recht heeft. Deze informatie moet desgewenst ook in de eigen taal van de koper worden verstrekt.<\/span><\/p>\n<p><span style=\"color: #000000;\">Ten slotte is de handelaar verplicht om, voordat een overeenkomst wordt gesloten, de consument te wijzen op het bestaan van het \u2018herroepingsrecht\u2019 en de duur van de herroepingstermijn, en dat het onwettig is om de klant tijdens deze periode een financieringsovereenkomst te laten ondertekenen.<\/span><\/p>\n<h5><span style=\"color: #00004d;\"><u>Samenvattend zijn de belangrijkste aandachtspunten van de uitspraak <\/u><\/span><\/h5>\n<ol>\n<li><span style=\"color: #00004d;\">Dat er een verplichte bedenktijd is van 14 dagen vanaf de aankoopdatum<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dat klanten op de hoogte moeten worden gebracht van deze bedenktijd.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dat er geen geld kan worden geaccepteerd bij de ondertekening van het contract of binnen de 14 dagen bedenktijd.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dat alle contracten schriftelijk moeten zijn.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dat alvorens een contract te ondertekenen, bepaalde informatiepunten duidelijk moeten worden gemaakt aan de klant, zodat de klant volledig op de hoogte is van alle voorwaarden. Gebeurt dit niet, dan vervalt het contract.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Het contract moet worden aangeboden in de taal van de koper.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dat bij opzegging van de overeenkomst door de klant, bijvoorbeeld tijdens de bedenktijd, ook alle overige gerelateerde financieringsovereenkomsten worden opgezegd.<\/span><\/li>\n<li><span style=\"color: #00004d;\">Dat de contractduur niet langer mag zijn dan 50 jaar.<\/span><\/li>\n<\/ol>\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>De uitspraak van het Hooggerechtshof heeft onderschreven dat alle contracten een afkoelingsperiode van 14 dagen hadden moeten hebben voor de aankoop van producten die geldig zijn in heel Europa.
