V\u00f3\u00f3r 1999 bestond er weinig of geen consumentenbescherming bij de verkoop van timeshare. Spanje was het eerste land in Europa dat wet 42\/98 invoerde, die op 5 januari 1999 van kracht werd. Wat is Wet 42\/98?<\/span><\/p>\n

Wet 42\/98 gaf timeshare-eigenaars nieuwe rechten en verminderde de verkooptactieken onder druk die voorheen in Spanje plaatsvonden. Zo werd de afkoelingsperiode voor de consument verlengd en mochten de resorts tijdens de afkoelingsperiode geen geld vooraf vragen. Timeshare-resorts mochten klanten niet langer onder druk zetten om op de dag zelf te betalen, ook niet als het om aanbetalingen ging. Als uw resort bij de verkoop van een timeshare geld van u heeft aangenomen, kunt u recht hebben op schadevergoeding.<\/p>\n

Wat waren de hoofdregels voor de verkoop van timeshare na 1999?<\/h4>\n
    \n
  1. Recht om het contract te annuleren binnen 14 dagen na ondertekening zonder boete.<\/li>\n
  2. Verlengde afkoelingsperioden.<\/li>\n
  3. Maximale contractduur gewijzigd in 50 jaar. Contracten kunnen niet langer eeuwigdurend zijn of geen einddatum hebben.<\/li>\n
  4. Betalingen kunnen niet on-site worden aangenomen<\/li>\n
  5. Contracten kunnen niet langer gebruik maken van de woorden eigendom, bezit of investeringen<\/li>\n<\/ol>\n

    Wet 42\/98 is sindsdien in juli 2012 vervangen door de huidige Europese wetten die vandaag bestaan. Deze bieden nog meer bescherming voor timeshare-eigenaars.<\/p>\n
